Overview
Nigeria’s port sector has entered a new phase of economic regulation following President Bola Ahmed Tinubu’s assent to the Nigerian Ports Economic Regulatory Agency Act 2026 in August 2026.
The Act establishes the Nigerian Ports Economic Regulatory Agency (NPERA) as the statutory regulator for the economic and commercial aspects of port operations and related services. It also repeals the Nigerian Shippers’ Council Act, replacing the previous regulatory framework with a dedicated statutory regime. For port operators, users and investors, the changes raise important questions around tariff regulation, regulatory oversight, compliance obligations and the cost of doing business at Nigerian ports.
